Terms of Service

EveryComment is provided by Paradigm Social Ltd, a UK company trading as EveryComment (“we”, “us”). You can reach us at hello@everycomment.ai.

EveryComment brings the comments, direct messages and reviews from the social accounts you connect into one shared inbox, so your team can read and answer them in one place. It can also:

• draft replies with AI, using a profile of your brand that you write or that we suggest from your website;
• learn from the edits your team makes to those drafts, so later drafts are closer to how you write;
• hide comments on platforms that allow it, when someone on your team asks it to;
• send the details of a lead to a web address you choose, if you set that up;
• show you figures about volumes and response times.

The AI never sends anything by itself. Every reply is sent only after a person on your team has approved it. You are responsible for what your team sends.

• You sign in with Google or with a link we email you. Keep access to that mailbox secure: anyone who controls it can sign in as you.
• The person who creates an organisation is its admin. Admins decide who else can sign in, and can remove people.
• You are responsible for what the people you invite do in EveryComment.
• You must be at least 18 and using EveryComment for a business, not as a consumer.

You may only connect accounts that you own or have permission to manage. We connect to the social platforms through a connection provider, Zernio, using the permissions you grant when you connect.

Your use of each connected account stays subject to that platform’s own terms and policies, including those of Meta (Facebook and Instagram), Google (Business Profile) and TikTok. We do not control those platforms. They can change or withdraw access, limit what can be read or sent, or suspend an account, and parts of EveryComment may stop working for that account if they do.

You can disconnect an account by removing EveryComment’s access in the platform’s own settings, or by asking us.

Drafts are written by a large language model from Anthropic, reached through its API. To write a draft we send it the conversation being answered and your brand profile. Drafts can be wrong, out of date or unsuitable. Read every draft before you approve it, in particular anything about prices, legal or financial matters, or health.

You are responsible for making sure what you send meets the rules that apply to your business and sector, such as advertising or financial promotion rules.

• Paid plans begin with a free trial of the length shown when you start it. No card is needed to start. If no payment method has been added when the trial ends, the subscription is cancelled and nothing is charged.
• After the trial, plans are billed monthly in advance, at the price shown in the product when you subscribed. Each plan covers a number of brands, and you can add extra brands for the extra price shown.
• Payments are handled by Stripe. We never see or store your full card details.
• You can cancel at any time from Settings. Your plan then runs to the end of the period you have paid for and does not renew. Except where the law requires it, we do not refund part-used periods.
• If a payment fails we will try again for a short time. If it still fails, your organisation’s access may be paused until it is paid.
• We may change prices. We will tell the organisation’s admins by email at least 30 days before a new price applies to you, and you can cancel before it does.
• Prices do not include taxes unless we say so.

While EveryComment is offered to you as a pilot without billing, it is free and we may limit the number of brands.

You must not use EveryComment to:

• break the law or the terms of a social platform;
• send spam, bulk unsolicited messages, or anything deceptive, harassing, hateful or abusive;
• connect accounts you have no right to manage, or collect personal data you have no right to collect;
• get at another organisation’s data, test our security without our written permission, or get around limits in the product;
• copy, resell or reverse engineer EveryComment, or use it to build a competing product;
• overload it, for example with automated requests.

We may suspend an organisation that does any of these. Where we reasonably can, we will tell you first and give you the chance to put it right.

The messages, comments, brand profiles and other content in your organisation are yours, or your clients’. You give us permission to store and process them only to provide EveryComment to you. We do not sell your data, and we do not use it for advertising.

The personal data inside those comments and messages belongs to the people who wrote to you. You are the controller of that data and we process it on your behalf. The data processing section of our Privacy Policy forms part of these terms. You are responsible for having a lawful basis for that processing and for telling your own audience how you handle their messages.

We will provide EveryComment with reasonable skill and care. We do not promise it will be uninterrupted or free of errors. It depends on other companies’ services: the social platforms, the connection provider, hosting, the database, the AI provider, email and payments. Messages can be delayed or missed when one of those has a problem, so do not rely on EveryComment as your only way of receiving anything urgent.

We may change or remove features. If a change makes the service materially worse for you, you may cancel.

EveryComment, including its software, design and name, belongs to us. These terms give you a right to use it while your subscription or trial is active, and nothing more. If you send us suggestions, we may use them without owing you anything.

• You can stop at any time by cancelling your plan and asking us to delete your organisation.
• We may end the agreement on 30 days’ notice, or at once if you seriously or repeatedly break these terms or do not pay.
• When the agreement ends, your access stops. We delete your organisation’s data as described in the Privacy Policy. If you want a copy first, ask us before you close the account.

Nothing in these terms limits liability for death or personal injury caused by negligence, for fraud, or for anything else that cannot be limited by law.

Otherwise:

• we are not liable for loss of profit, revenue, business, goodwill or anticipated savings, or for indirect or consequential loss;
• we are not liable for what a social platform, or another company we rely on, does or fails to do, or for replies your team chooses to send;
• our total liability to you in any 12 month period is limited to the fees you paid us for EveryComment in the 12 months before the claim arose, or £100 if you paid nothing.

You will cover our reasonable losses if a third party claims against us because of content you sent through EveryComment or because you connected an account you had no right to connect.

We may update these terms. The date at the top shows the latest version. For a change that matters, we will tell the organisation’s admins by email at least 30 days before it applies. If you keep using EveryComment after that, you accept the new terms. If you do not agree, you can cancel before they apply.

• These terms, with the Privacy Policy, are the whole agreement between us about EveryComment.
• You may not transfer this agreement without our consent. We may transfer it to a company that takes over EveryComment, and will tell you if we do.
• If part of these terms cannot be enforced, the rest still applies. If we do not enforce a right straight away, we can still do so later.
• Nobody other than you and us has rights under these terms.
• Neither of us is responsible for a failure caused by something outside our reasonable control.

These terms are governed by the law of England and Wales, and the courts of England and Wales have exclusive jurisdiction over any dispute about them.
